Well (an idea)???
If you can, determine what is using that file and use Activity Monitor
  to quit the process, hoping that it is NOT one of the system-critical
  processes, then try emptying the trash.
Or (if you care to)???
Look up in Mac Help about enabling/disabling the root user, and
  then login as root, do the deed (empty trash), logout, and login as
  yourself again (remember to disable root when task is finished).
Or (some searching)???
  Find a system utility that will allow you to force-empty the trash.
Or (get some more info from MacGroup gurus)???
