Of course it is a little more subtle than that. Android's Dalvik virtual machine is licensed under the Apache license, which is considered an OSI approved license. So Android is open source. There is also a contribution agreement which some consider onerous and perhaps pushes Android a little further away from open. The fact that you have to use a Java-like syntax but you don't have ordinary Java libraries makes the Dalvik virtual machine something of a black box.
