No, patents and copyrights are specified in the constitution for the purpose
of promoting the useful arts and sciences. But monied interests have
subverted this to extend copyright protection to the life of the author plus
75 years. How does 'owning' and idea into the afterlife promote creativity?
Patents fortunately have not been extended to the same ridiculous lengths. I
am less concerned with the span of patent laws than what has been allowed to
be eligible of patent. Species and life forms, business practices as opposed
to inventions. 

You really should read Lessig. A concern of mine that he does not mention is
that current law breeds disrespect for all laws. Given the ease of
transmission of ideas, even complex ideas like feature films and music,
there is no way to enforce current law. It makes no sense whatever to have
unenforceable laws.
