Some people claim at those bitrates, layer 2 is a better choice.
It is also better if you ever want to edit or remix.  

MPEG did very detailed listening tests in
ISO MPEG 91/010 "The MPEG/AUDIO subjective listening tests"
I've seen the results somewhere on the web (maybe mp3tech.org?)
I think the conclusions were that expert listeners could not
reliably tell the difference between original and compressed at
256kbs  (using the reference FhG encoder)
