Part of the reason a smoking ban is wanted is for the benefits of the
workers, who have to breath in the smoke eight hours a day.  Having some
places smoking only wouldn't help them at all, and that is unfair.

Sure, we could tell the applicant "This is a smoking bar, I hope that is
okay", but that is like telling someone, "This bar has asbestos falling from
the ceiling, I hope that is okay".  It is the responsibility of the
government to enforce laws that protect workers.  If you leave it up to the
businesses, they better have good insurance.  I can see $xxx'000,000
lawsuits in the future from employees who develop lung cancer on the job.  

So, I think that a lot of us are looking at this the wrong way!  The ban
isn't supposed to just protect the people who frequent the bars and
restaurants, and I think we are all forgetting that.
