You must clearly indicate that every mention of "roll a d20" and any
other use of a rule is OGC. The only OGL release I've seen so far has
been The Wizard's Amulet and I think it is in violation of the today's
license because there are sections which meet the definition of OGC
yet are not clearly indicated as OGC.
I've read the Open Game Content sidebar at the back of TWA, and I
don't think saying "any material derived from the d20SRD is Open Game
Content" qualifies as clearly indicating the portions of TWA which are
OGC.
If that does qualify, then I withdraw my suggestion. But then I wonder
why you bothered using the gray boxes at all. Nearly everything in the
gray boxes was clearly derived from the d20SRD. Indeed, why would
anyone ever do anything other than state, "everything derived from
<list of sources> is OGC." Of course, they would have to somehow
indicate that the new rules were also OGC -- hey, this is the exact
result I was trying to achieve with my suggestion!
Perhaps Ryan could weigh in here and even if he disagrees with the
suggestion, let us know if he considers the "everything derived from"
method valid under the OGL.
