Eye, there's the rub!

There was some talk of an open mark that meant d20, but it isn't easy to
implement.

I can't speak for Wizards, but Ryan has been extremely...nonchalant...about
use of SRD material before it has been officially released.  That isn't the
same as permission, but it does allow for some work to be accomplished in
anticipation of the final release.  Be aware that any work you do based on
the SRD might have to be revised when it finally does become official.
