Once again, wrong! :)

What we are all doing is operating under a draft
version of the license which Ryan has given us
specific permission to do. However, he has also
indicated that the book names are in fact going to be
claimed as PI or trademarked terms by WotC. Thus, to
comply with his permission to use the draft version of
the license and SRD, we are bound by his particular
strictures--no Monster Manual, no Players Handbook, no
Dungeon Master's Guide--just like no other trademarked
terms. My guess is that those terms will be added to
the list in the d20 license guide as restricted terms.
Hopefully, they will decide we can use those terms.

But for right now, Ryan has asked us not to.

He has aksed us to limit our reference to the rule
books to this reference only:

"You may, at your option, include the following text
in a Covered Product:

"Requires the use of the Dungeons & Dragons(R)
Player's Handbook, Third Edition, published by Wizards
of the Coast(R)

If you elect to include this text, you shall include
the following legal text in a reasonably legible font,
point size and color:

"Dungeons & Dragons(R) and Wizards of the Coast(R) are
Registered Trademarks of Wizards of the Coast, and are
used with Permission." "

It may be that the final version does not have that
limitation. I agree that if the draft version were
released right now, it does not appear that "Monster
Manual" or "Dungeon Master's Guide" or "Players
Handbook" are claimed anywhere as PI so you could in
fact refer to them. But we are operating under Ryans
permission and the conditions he has set on it.

No, you cant write "whatever the law allows you." You
can only use the SRD material pursuant to Ryans
permission to use the draft of the SRD, which has the
restriction that you cant say "Monster Manual" or
"Dungeon Masters Guide." So actaully WotC has
contributed open content, through the draft SRD which
we have access to by Ryan's permission to use the
draft license.

Maybe Ryan has changed his stance on this, but that
was the skinny last I knew....
