I dont think focusing on avoiding monetary damages is
really the key for a small game company like anyone
here on the list.
Monetary damages are awarded at the end of a
successful law suit.
The killer to a small company is not the award at the
end but is the lawsuit in the first place and the
attendant costs. Hiring an attorney, complying with
orders, filing paperwork. Getting sued is expensive.
I think you should worry more about being in the safe
harbor and scrupulously complying with the d20
license/OG license and thereby avoiding getting sued
at all rather than worrying about limiting damages at
the end.
Even winning a lawsuit can sink a small company.
