But as a gamer, you can do whatever you like. Now, as a publisher, the NAME 
and the DISTINCTIVE DESCRIPTION and the ILLUSTRATION are about the only 
things that we can maintain real control of. The stats are obviously 
derivative, as are almost all new Feats/Powers/whatever. And in the case of 
something like S&S Creature Collection, many of the names include elements of 
the world they created. Making them OGC would be like giving away the whole 
enchilada.

But then again, I'm one of the leech publishers, so I am biased.
