I would say it encourages Open Gaming in general, as long as it is done intelligently. As pointed out by others, the route proposed for Action is not the most, um, well thought out, in general appearance. Worst case scenerio: I get a wild hair up my backside and decide to screw GoldRush.. So I make a product, using their new system, which has obscure references to copyrighted material. They don't know it is copyrighted, and approve it. I then send a copy to the copyright holder, and dare them to bring legal action.. Then I quietly fold like a house of cards, but point them to GoldRush, saying 'They approved it and all that rot, go after the money and I will give you all the help you need..' Now GoldRush is the target.
Its all bad juju when you drag a third person into something like this. I am, however, looking forward to seeing what their gaming system is like, etc and may even consider something in that venue if their licensing gets sorted out in a manner that makes more sense. More games is always good..
