At the moment, yes there isn't any problem with what they are doing. Each of the Monsters that they describe in their product is open content in the SRD. Face and reach are fine. The SRD doesn't have much of descriptive text however, for instance the Ankhege is never once listed as being an insect. Still, that's treading the line at most.
What's going to catch my eye is how they publish it in order to keep it with the OGL. I imagine a book that you can cut the peices out of would be the best option.

|Subject: [Ogf-l] can they do this?
|
|
|wandered into a site this morning that caught my eye.
|
|http://www.dragonscalecounters.com
|
|Seems they have created their own art for many of the
|mainstream monsters from Core Rulebook III (monster
|manual) and are selling them as counters. My friend
|suggests its ok because the names (and the face/reach
|stats implied in the counters size) are released under
|the gentleman's agreement of the SRD. I say the
|artwork is derivative and the names are PI. He
|counters that other companies such as Fiery Dragon
|have released (and are intending to release more) of
|these exact same pieces. Which of us is right and if
|what they are doing is not ok, what differentiates
|their product from other similiar?
|
|Thanks in advance
