That's not true. The Adobe site has a good FAQ on copyrights as they apply to art (http://www.adobe.com/web/features/copyright/main.html), an area the LoC site FAQs are lacking in. If you see a picture or drawing, and then draw your own picture based solely on that work (or several works by the same person), you've created derivative artwork. If you use a picture or artwork from many sources, and it's not obvious you took from any one source, then you're fine, even if it's the same subject. There is no artwork of, say, an Ankheg outside of Wizards, as they created the creature. Now if you find a lot of artwork of Ankhegs by different artists and create a drawing based on that collection, that may be different, depending on who owns the art but I don't know.
