The artwork in no way looks identical to the source used.  The art work is
ONLY questionable IF you can find a similar overhead view of a "Beholder".
Besides, WotC can lay claim to very little of their monsters as being
IP/PI...at least in appearance (but that is another topic).  The art is
completely different AND because the SRD (though only released under the
Gentleman's Agreement) includes the names of the monsters, he has free use
of the names without having to give up the rights of the art work...

Very nice...
