Will this situation change once the D20STL allows you to make specific
references to the MM? I understand you can't repeat the text of the MM
in your adventure but might not there be a way to adequately describe
the encounter and then say, "for more information on the "Mind Flayer"
please reference pp. 136-7 in the MM published by WoTC" ?

I realize that the guide says you "should not" use specific page
references but that's different than "shall not", right? Also it says
that you may explicitly reference chapter, heading and sub-heading
titles. The heading title in the MM is the name of the monster itself.
So you could say "reference the Mind Flayer Society sub-heading under
the Mind Flayer heading in the MM for more information." (The example
language is awkward, just trying to make my point)

Since Illithid is not a heading or sub-heading title, you still can't
use that term without some other form of permission.

It seems to me that you would be able to use the Mind Flayer effectively
this way. You wouldn't be able to create the "Slayer's Guide to the Mind
Flayer" but you could throw them into an encounter without too much
trouble.
