It isn't the issue.  Ideas are already free :-P

Given that the OGL is exactly about using other peoples work, I think it's
kind of contradictory to suggest otherwise.  Some of us are working on "new"
stuff and some of us are also working on "old" stuff and some are working on
things in between.  Frankly, for me the whole D20 and OGL thing is still a
"maybe" as it is, but I am very interested in "open" concepts, which have
everything to do with the ability to reuse.  If your not interested in reuse
at all then you don't need to be concerned about open issues, because they
probably won't affect you.
