That is what I thought, however, Mynex from the PCGen development team
is saying this:
"So here's the deal and this comes from _WotC_ lawyers, so make no
mistake this is the situation.

Since PCGen's inception, since the very 1st data files were included, we
were OGL compliant. How so? The second ANYONE uses and OGC content,
they have accepted the conditions of the OGL."

This can be somewhat backed up by section 3 of the OGL.  I do not
currently receive Dragon and Dungeon at the moment.  But since they
are no longer a publication of WOTC, have they "... accepted the
conditions of the OGL"?  I don't think that section 3 can be taken out
of context like that, can it?
