In the interest of devil's advocate.  What about Dragon mag and
Dungeon?  What about Kingdoms of Kalamar?  How do they jive with
section 3?  Even though these guys have an agreement with WOTC to use
their copyrighted stuff, it seems like section 3 would apply to them.  

What is the purpose of Section 3?  It seems there should be an escape
clause saying that if you have the Copyright holders permission to use
the material outside of the OGL than everything is Kosher, otherwise
you must abide by this license.

PCGen is in a different position.  They're basically saying they've gone
along with the spirit of the OGL while not exactly following the letter.
Which is mostly true.  They were attempting to publish under the normal
copyright laws but follow the spirit of the OGL (and them some, they were
asking publishers if they minded being included).  I doubt that's a direct
quote from Wizards legal, he's probably paraphrasing, but hey, I'm not a
lawyer so I guess they could have said that.
