In the interest of devil's advocate. What about Dragon mag and Dungeon? What about Kingdoms of Kalamar? How do they jive with section 3? Even though these guys have an agreement with WOTC to use their copyrighted stuff, it seems like section 3 would apply to them.
What is the purpose of Section 3? It seems there should be an escape clause saying that if you have the Copyright holders permission to use the material outside of the OGL than everything is Kosher, otherwise you must abide by this license.
