Because the OGL declaration would clutter up the book and add to their
already considerable workload for virtually no benefit to themselves. The
only reason anyone does it is because they have to, and Wizards doesn't have
to.
Essentially, marking portions of new material as OGC is something that they go through anyway.
Perhaps they don't want to bother the 98% (?whatever the figures are?) with legealese thats unnecessary for the typical hobbyist gamer. If thats the case, there is an increasing number of hobbyists "publishing" their stuff on the interenet (new rules, adventures, home grown campaigns, ...). Perhaps the percentage is still too small to throw all that legalese detail into published books?
