If you're talking about a book that is using OGC from other publishers (a collection of PrCs or Feats, for instance), I would imagine that one of those publishers would have standing if their OGC was not clearly identified.
Ha Ha - I'd like to see the Net Book Community Council scrape together the nickels to sue Mongoose. Maybe they could have a car wash.
No. I am not referring to the particular book in question. All Mongoose did was copy a sloppy and unclear OGC designation from other publishers. Mongoose had many precedents. But it is such an obvious violation of the "clear designation" clause of the OGL that nobody is even bothering to suggest that it isn't a violation - unheard of for this list.
Actually I was talking about the precedent that was set - and ignored -when the first OGL publishers began using WotC open content with such meaningless OGC declarations.
WotC (er' Hasbro) owns the licence. They set the precedent for its use. They are also the ones in the industry who are far and away the best funded and most in a position to defend the license. I am not aware of any other OGC publisher with an in-house legal staff (and I don't count Clark as his own staff - sorry Clark).
The "everything derived" designation is becoming a de-facto fallback for either a) lazy publishers, or b) publishers that want to ensure that nobody ever reuses their material. And judging by the products I have seen lately it is becoming the industry standard - which is what it WILL DO unless it is challenged.
I personally don't view that as a good thing.
