Close. I have states which are not connected to anything, however it is not the 
case in that rendering pass. When the app is started, a visualization is by 
default activated that does have an empty state. After switching to the 
visualization I am now debugging, no states other than the one containing the 
shader is used. So it looks like the empty state is permanently damaging the 
state sorter.
