  true.. but by registering as a developer and clicking the
  "i agree" button on a big legal disclaimer (like JavaSoft
  does) should be sufficient.

  right now.. Microsoft did it to JavaSoft.. and they went 
  to court.. Microsoft did not do so well in that battle.. it
  is the same kettle of fish.

  put disclaimers in the downloads.. a little "license.txt"
  file or whatever.. if it is stated that the information
  is proprietary.. it will not be public domain!
