Sure, bad RAM.  Happens all the time.  It used to be quite rare, but 
with the tight margins quality control seems to have suffered.   I 
got seven out of eight bad 128 MB modules from Velocity Upgrades in 
one order.   Three out of ten bad in another order.

The seller should exchange it or refund your money, assuming it 
really is bad RAM and not some other bizarre issue that looks like 
bad RAM.  But if it works without the RAM and not with the RAM...
