If you run RealPlayer and look at the protocol and codec statistics
dispplay - you will see the audio stream encoding at 40kbits/sec. There
is transmission protocol overhead which means a 40kbit/sec data speed is
not enough.

Some (not all) listen again programs are better quality so that may be
the 64kbits.

If you read the BBC answer - at no point do they say the audio encoding
rate is reduced - they talk about buffers and transmission.

What speed is your modem link ?
Run RealPlayer , play the BBC streams - what are the codec and
protocols statistics values displayed ?
