What type of dock are you using and are you seeing the same thing when the iPod is not docked? I have mainly tested this using iPeng 7 (which shares the same playback code with previous iPeng versions) but you are not using that, right? Maybe I have to do more testing with the old version to reproduce it. Is the iPod/iPhone you are using to _control_ always running iOS 7? Putting up another row of permanently visible controls on iOS 4 would mean I'd have to about halve the size of the artwork (it would be a bit less on iPhone 5) plus adding a lot of horizontal space around the artwork.
