Ed .. I've been in a similar lawsuit over a house. The first house we
purchased had evidence of water damage in the basement. The Seller's
disclosure statement clearly had written on it that there was previous water
damage but the owners have resolved the problem. We hadn't lived there 2
weeks and our basement was flooded!! I thought it was a cut and dry case ..
they stated the problem was fixed .. it clearly wasn't .. it's their
responsibility to fix it. Yet it took TWO YEARS in the court systems and in
the end we won, but the amount wasn't enough to fix it especially after the
lawyers took their cut.

So after my two legal battles .. I have lost all faith in our legal system.
It's a mess and out of control. My children repeatedly told people that
their father was violent towards them .. they told their attorney, they told
two psychologists, they told school personnel, they told doctors, and they
even had a one-on-one conversation with the JUDGE .. and nobody did anything
to protect them .. even though all of those people are "mandatory reporters"
meaning they MUST inform the authorities of suspected abuse. It wasn't until
they saw the third psychologist that it was reported to Child Protective
Services ... but they blew it off too. Even the police officer that came to
one of the scenes blew it off despite noting on file that the father was
intoxicated. The officer never went into the house, he briefly interviewed
my son in the front yard while standing 5' from his father, my son was
physically trembling and crying uncontrollably and the officer couldn't
understand him .. yet the officer blew off the incident and drove away
leaving my son with the violent father who was intoxicated!

It's mind boggling what has happened to our system.

And then there's our medical system .. don't even get me started on that!!

I think that they must teach that the first day of law school. I
have
been involved in several such cases in my days as a building
inspector. In fact, in one instance I noted that the heating system
was severely rusted in the firebox and should be replaced immediately.
The next winter the furnace failed, and the owner sued me because I
didn't catch that in my report. Now here you have a document that was
given to lawyers, real estate agents, and principal parties on both
sides of the transaction, where it clearly states in no uncertain
terms that the furnace should be replaced, yet they were permitted to
sue me for the exact opposite reason. Of course, the plaintiff was a
lawyer himself, so he wouldn't be forced to spend thousands in a
baseless action, but I would.

This whole thing smells of personal vendetta. I wonder what the
potential for income would be for computer articles that are a decade-
plus old; my guess would be zero. I think that I'll steer clear of
this whole train wreck.
