certain offending material off his server.


Another country may choose to prosecute its own citizens for what they 
post on this list or may choose to block access to the list within 
their own borders, but they can't do anything to the listmiester here 
in the U.S.

Oh, it is then that you and I were looking at it from different angles. 
I wasn't worried about Doug, as he was not the one saying nasty things. 
I thought about the punishability of the non-U.S. citizen misbehaving on 
the list so that such a question might arise.

I agree that ad hominem attacks should be strongly discouraged. If someone 
wishes to attack another personally, he should do it off-list. As they say in 
saloons, take it outside, guys. When ad hominem attacks happen on-list, they 
invariably disrupt the forum and the function for which this list was made 
(discussion of Pentax photography).

nonsensical. I don't need to be granted a right to ignore what I
choose to ignore, no one can make me pay attention to it, although I
do need to be prepared to deal with consequences if what I ignore is

That such individuals take umbrage to the statement 'I ignore you' is
an indication that what I say is important to them. My statement
clearly indicates that what they have to say is unimportant to me. I
post it publicly as my indication back to them that I find their
nonsensical behavior inappropriate and not of interest to me, in the
hope that they become conscious of their behavior. I don't hold much
expectation of that hope having any realization.

More hyperbolic invective, when I partake in it, is generally intended
to be so over the top as to be obvious that I find the discussion
absurd or ridiculous beyond the tenor of sense and reason, but not
without a humorous side. It is intended for humor's sake, and my
apologies if some find the humor of such invective lacking. I chalk it
up to my youth spent in the Bronx ... ;-)

we've all had our say in this so why not? and I doubt he'll stir the
pot much because this discussion wasn't about him all that much. it
was about William's transgression as perceived by some and I don't
think anyone here was calling for infringements of expression. it has
all died down, William may or may not be gone, Godfrey is still here
which is good as far as I'm concerend, so no big whoop. we can all go

I don't understand why people think it is their right to use the the
word faggot and then get all hurt when someone exercises their right
to call them a jerk.  Bill wasn't banned, he left on his own.  I
wish he had stayed because I often liked what he had to say.  But you

forum, and generally ignite a purposeless day or two of hostility. Inasmuch 
that they have nothing to do with Pentax or photography, they are best avoided.

On the other end of the spectrum, there are photography forums that are so 
closely monitored, one can get a reprimand for bringing up the topic of 
fountain pens. Just last year, I got a rebuke for asking for opinions on 
folding bikes on the LUG.

I'm not atacking the constitution. You Tom, and others may, may
practise the constitution as mush as you like, but please don't take
it for granted here. Doing so, could be interpreted as, how do I put
this? A bit self centered?

Indeed,

Bill's actions are protected by the Charter of Rights and Freedoms,
not the Constitution. Godfrey's are protected by the First Ammendment
to the US Constitution, other list members' speech is protected (or
not protected) by the laws of where they live.

Are they?  The list server is, I think (please slap me around if I'm
wrong), located in the US.  I'd like to think, and if it were up to me
they would, that anyone within the borders of the United States would
enjoy the same constitutional guarantees as a citizen.  All men and
inalienable are powerful words.  But since we're not all in the same
place, who's laws apply?  If the list server were located in Iran,
could our Iranian friend Doug Brewer be prosecuted for blasphemy when
some loudmouth atheist/Christian/Jew in some other part of the world
spouts off?

That's an interesting statement, Adam.  I'd be curious to know how
well our governments have worked this sort of thing out, but I'll
probably be disappointed by the answer.  If there is an answer.

 closely monitored, one can get a reprimand for bringing up the topic of
 fountain pens. Just last year, I got a rebuke for asking for opinions on
folding

corner for 10 minutes.

It depends on the jurisdiction where the server is located.

In the US it is generally held that ISPs, list service providers, c.
are protected by common carrier rules.  This means that as long as
they don't exercise a priori censorship and the like they can't be
prosecuted for what shows up on customer content parts of their sites,

Rules in other parts of the world may well differ. And even in the US
there are some rules that have to be followed; protected speech is
not an absolute carte blanche; laws on libel (and hate speech) apply.
An ISP, list provider, etc. may have to remove offensive content if
so ordered by the courts, and may be found liable for damages in the
civil courts; as others have pointed out, freedom of speech does not
mean freedom from all consequences of that speech.

would be protected, who's laws apply?  Or rather, who's laws should
apply?
