[OSM-legal-talk] Extent of share alike?
Hello, I have made a map and business guide from scratch that you can see here http://www.mineraldata.com.au/wp/index.html [1]. I would like to share the map data with OSM and use OSM as a base map for this and other maps/ business guides - I assume there is no problem with this as long as I attribute the work. However, my question is, how far does the share alike section of the Creative Commons licence go. I want to share the map data with OSM but not the other sections of the work. Will the Creative Commons licence mean that the business guide section of the work fall under the Creative Commons licence. The business guide essentially is business addresses, industry, service, phone no, website etc and the location of the business. I will most likely add cafe's, public phones, post boxes and hotels to OSM but I don't want the entire business guide to become Creative Commons (not at the moment anyway). Is someone able to clarify this? Can I just share the map data? Pieren pieren3 at gmail.com writes: I don't like this thread because it could leave the impression that tracing on orthophotos is not a copyright infringement. Unfortunately, it is. I don't know how important it to struggle about copyrights and tracing vector data on imagery. It should be enough to say that using imagery from Google Earth or Google Maps may be against Google ToC, even it is not clear, and we have our own rules that as long as it is not clearly allowed we do not use it for OSM. But this copyright thing is so great fun that I'll continue it a bit. Let's see the satellite image layer with Google Maps or Yahoo Maps. You can read there, for example, Imagery (C) DigitalGlobe, GeoEye. What does it mean? It gives a hint that the copyright of the imagegy does not even belong to Google or Yahoo. Have a look at standard license of Spot Image http://www.spotimage.fr/automne_modules_files/ftp-generic/eula-E.pdf and QuickBird license http://www.digitalglobe.com/digitalglobe2/file.php/646/QuickBird_Imagery_Products-Product_Guide.pdf Both of the companies do mention vector data derived from imagery in their license terms. Both are saying that customers can create derivative vector data and do what ever they want with those data. Neither of them claim that the image companies should have any copyrights over the derived vector data. Buy a license from Spot Image or DigitalGlobe and you can trace what ever you want (not including DEMs) and upload the data into OSM without a bad word. My conclusion is that tracing from Google may be Google ToC infringement. If it is copyright infringement then Google is not the other party, it is the image company. And then it would be a bit odd that it is an infringement when the same imagery is looked through Google API but not when looked through Yahoo API. It may be true, still, odd things happen and Google and Yahoo may have made different contracts. Yahoo obviously paying more because of more open licence terms? But all in all, because of uncertain ToC situation it is better not to use Google or Bing satellite imagery in OSM. ___ talk mailing list talk@openstreetmap.org http://lists.openstreetmap.org/listinfo/talk

The copyright on the shape and location of the road would be held by whoever designed the road - which makes for an interesting predicament in any jurisdictions which would uphold such copyrights. That's flat out wrong. The reason they ban cameras from concert events etc is because they can prevent you from taking photos, but once the photo exists it is copyright to the person that took it. I didn't say anything about concert events. As for the design of the road, Ford tried to asert it owns the look of it's cars over some car enthusit group that made a calendar, Ford ended up backing down but it was unlikely they would win other than by bankrupting the other side. To be copyright infringement you'd have to copy the technical plans. Yeah well, maybe in the US. In France you can copyright a building and anyone who takes a picture of the building and uses it for commercial purposes without permission is committing copyright infringement. Maybe they'd be willing to extend that to roads, at least in the case of a road with a unique design - who knows. The problem with traces is more than just a breach of contract. No it's not, you are deriving, not copying so it's breach of contract, that is if there is a TC stating you can't do it. Deriving *is* copying. You can't create a derivative work without copying. At least, that's what courts in the US have explicitly come out and said: creating a derivative work necessarily involves copying - no copying, no derivative work. Does the fact that an aerial image was once part of a database really taint the use of that image forever? If so, you can stretch that to absurdity. A collection of Shakespeare poems is a database. Does that mean that copying a poem from a Shakespeare poem database and putting it in Wikisource is copyright infringement? What if 100 other people do the same thing with the same database? Re: [OSM-talk] Garmin eTrex Vista Hcx
It is probably a fairly common GPS use issue as opposed to a Garmin issue There are many reasons for this not least of which is that all manufacturers lie about the accuracy of their units in real - world use (as opposed to theoretical accuracy tolerances) That is why surveyors and other professionals use specialist high accuracy equipment, tables and have specialist training qualifications to match etc. You can find plenty more info on this by googling, some examples: http://en.wikipedia.org/wiki/Global_Positioning_System http://www.kowoma.de/en/gps/errors.htm http://gpsinformation.net/main/altitude.htm http://www.educatedguesswork.org/2009/03/correcting_for_gps_altitude_er.html The easiest ways for the OSM mapper to minimise this effect are: 1. maximum number of satellites up 2. go on multiple days to minimise daily accuracy variations 3. clearest possible view of the sky 4. average the results 2009/11/2 Apollinaris Schoell ascho...@gmail.com: Nop wrote: Hi! [OSM-talk] Suggestion for JOSM
I have been using JOSM for the last 2-3 months for making changes to OSM. A practical issue I see using JOSM is it shows the GPS trails as light red lines and then the user needs to draw nodes on those trails. Drawing these individual nodes, taking care that each curve on the road is taken care of by drawing multiple nodes (I have been mapping mountain roads primarily) is quite a tedious task. Given my limited understanding of mapping and even more limited understanding of computing, I think it would be better if JOSM assumed the trails to be correct and drew nodes on it on its own. The user could then delete whatever he feels is irrelevant or not needed and make changes wherever necessary. The downside to this would be repeat roads getting drawn if users forget to delete tracks for a road which is already on OSM.
Get liefert die Fehlermeldung Set up tile server in OSMTracker first, obwohl ich das gemacht habe.
