If you operate a business from your home and send your drone up to check
your gutters for leaves, you need a license

So, I went and brushed up on the non-commerical rules just because I
haven't paid much attention to them recently, and they seem to have changed
a bit, probably partially due to the law which was passed a few months ago
...

I agree 100%. For non-commerical, everything I read indicates that within
5 miles of any airport/heliport you simply need to call the airport
owner/tower/etc. to notify them of your operation. The under 400ft
requirement seems to have largely been excised from the FCC website, even
though I have a copy of paperwork that I agreed to back when I did my
original drone registration which says that I agree to fly under 400 ft.

But, the class at wisapalooza can be summarized in one line:

"If you're using a drone for commercial purposes you need a license.
Inspecting a tower for a WISP you own or work for is going to almost
certainly going to be a commercial purpose. Go get a license, which will
also teach you all of the rules you need to be following, which are
different than the non-commercial rules."

constitutes approval after talking to the tower, 400 foot limit is in

If you're flying as a hobbyist within 5 miles of any airport, helipad,
etc. (towered or not) you need a FAA waiver. In addition, you're
limited to 400ft, can't fly over certain areas, etc. One really

If you have a commercial license then where you can fly is based on
the actual airspace classification instead of the five mile limit.
Much of the knowledge needed for the test revolves around
understanding how to know where it is safe and legal to fly based on
charts and observation.

its a relatively cheap license, and there are a bunch of flight apps to
ensure youre flying lawful, some drones even incorporate it

If you're flying as a hobbyist within 5 miles of any airport, helipad, etc.
(towered or not) you need a FAA waiver. In addition, you're limited to
400ft, can't fly over certain areas, etc. One really should read up on
and follow the rules, as they're not just there to irritate drone users.

If you have a commercial license then where you can fly is based on the
actual airspace classification instead of the five mile limit. Much of the
knowledge needed for the test revolves around understanding how to know
where it is safe and legal to fly based on charts and observation.

I'm still trying to figure this out, since any Hawaii-to-Hawaii flight
going between any two islands could be beyond 12 nautical miles, but still
be within the exclusive economic zone, no?

This is the sort of question that probably ends up in an Admiralty Law
course.

It looks like laws changed as of today.
http://www.faa.gov/uas/media/Part_107_Summary.pdf and it appears most of
the pages including the application for the section 333 exemption are no
longer live. You will now have to pass an in person test administered at a
FAA testing facility or in my case as a Part 61 pilot take an online
training course.

*Q: I have a drone and would like to use it to

I won’t sell any pictures. Is this commercial use?*

A: Yes. The FAA views any UAS (drone) operation
that supports the functions of your business as a
non-recreational use. Curently, any
non-recreational use of an unmanned aircraft
requires a Section 333 exemption from the Federal
Aviation Administration. Once the small UAS rule
is in place, which should occur later this year,
you will then be able to operate commercially
under the new regulation.

Anyone want to buy Phantom 2 and lots of batteries? Actually I have 2
Phantom's 1 as a spare and never flown, a Taranis FRSky Transmitter and 7
batteries. FPV setup as well for a Go Pro with monitor. Works great. I am
just tired of all the bullshit that goes with flying and people lame ass
reactions. Plus, editing video sucks.
Make me an offer.

Re: [AFMUG] Drones and laws

2016-06-20 Thread Jon Paul Kelley
I was at a Drone informational session earlier this year at the NATE convention
in New Orleans and the information that was given there was that any commercial
operation of a drone required the operator to be, at least, a sport pilot.

never mind, i guess this answers the question

Q: I have a drone and would like to use it to monitor my business, such as by
checking my roof. I won’t sell any pictures. Is this commercial use?

A: Yes. The FAA views any UAS (drone) operation that supports the functions of
your business as a non-recreational use. Curently, any non-recreational use of
an unmanned aircraft requires a Section 333 exemption from the Federal Aviation
Administration. Once the small UAS rule is in place, which should occur later
this year, you will then be able to operate commercially under the new
regulation.

2015-07-30 Thread That One Guy /sarcasm
I remember reading about farmers getting smacked for surveying their own
fields, but it was from on of those threepercentnation type rags, so salt
needed

But we have a guy with one who is going to do some demos for us to see if
its worth getting one. Im pretty sure the boss just want to try that
particular model out before he buys one, I dont think there is any if in
the decision

The FAA rules make this difficult. Last I checked using a drone
 commercially is a big no-no.

Re: [AFMUG] Drones Inspections

2015-07-30 Thread Eric Rogers
I thought the commercial use (for hire) was only authorized with a
commercially licensed pilot. Hobbyists have raised the question to the
FAA, but I didn't think there were any rulings. I would love to use a
drone, but I also don't want fines from the FAA, along with risking
fines from the FCC...

I know Mark Radabaugh was telling me some about this. Maybe he can
chime in here.
