[WISPA] Form 477 Reports Due Sept. 1st

This is a reminder that the FCC Form 477 Report is due September 1st.  All
broadband service providers, (telecommunications, cable, and broadband over
power line providers) must report broadband services by census tract, type
of technology, and upload and download speeds on the FCC's Form 477.  The
Form 477 is due twice a year - in March and September.

This is not an invitation to discuss the politics which created this law.

[WISPA] Form 477

I know it's not Form 477 panic season, but I am just working on a few 
items in my database to get a cleaner count next time, and I ran across 
something I had not noticed before.

On page 26, it instructs:

Include census tracts within your defined service territory (see 
instructions) that have no broadband customers.
   - Enter 0 in any cell that permits connections and also in the 
corresponding cell for percentage residential

Anyone doing this?  This goes beyond what we've been doing, and would 
seem to require some more advanced coverage mapping to not only find our 
existing customers by census tract, but also all census tracts we CAN 
serve.  I believe this same data is what he broadband mapping folks will 
be looking for as well.

I guess I need to go see instructions to find out what exactly 
service territory means.

[WISPA] Form 477 Utility - futher notes

Just wanted to add a couple more things to be aware of. The csv files 
should not have   around the values. They should be:

first,last,address,city,state,zip

for the desktop geocoder and:

first,last,address,city,state,zip,lat,lon,up_rate,dn_rate,tech_code

for the upload file.

XL and Open office try to export to CSV with   around the fields 
unless you specify not to have them. Also, if you are submitting 
pre-geocoded data, make sure that before exporting your csv from a 
spreadsheet to format the lat, lon columns to be a decimal with 5 places 
after the decimal point. I know open office cuts off the last 3 places 
in the default format so that lat/lons came out like 42.35 and -96.21. 
This is not enough accuracy for proper tract referencing. If you get an 
http error when trying to submit, send me an email (cc...@wispmon.com) 
and I'll tell you what is wrong.

[WISPA] Form 477

This is a reminder to file your form 477.  It was pretty easy this time, I just 
had to geocode new customers and note what tracts where I lost customers...  
then I just copied the cells over from the last filing, making adjustments as 
necessary.

Maybe WISPA should have an auto reminder each time the 477 is due.

Then I guess you do not want to evolve into a public utility.  Too bad, as 
the rest of the WISP industry is becoming defacto public utility.  You 
really need to become familiar with the principle of common carriage.  The 
legal doctrine can be traced clear back to the Roman Empire.  Personally I 
want the sanction and protection of the king, but in exchange I must be a 
good steward and must comply with some regulation.  So, I will be granted a 
fiefdom and rogues will be assimilated.

 want to do.   Often, little funding is available for this, and they
 substitute days, weeks, or even months of time and personal effort
 instead of hiring research companies or marketing consultants, or buying 
 the
 data outright.

 In the case of a wireless ISP, for instance, one of the most critical
 elements for success, is to map out an area, and then begin
 building out a network.  Many such WISP's are one or two man operations,
 and start with minimal capital, usually enough to get
 started and operate in a limited area for a short period of time.   Then,
 funding from operations then provides capital for expansion
 and improvement of infrastructure.

 During this phase of the life of a WISP, the financial situation is
 generally very fragile, and a loss of markets to move into will
 generally cause business failure.

 If WISP's are required to do even MORE work, such as finding census 
 borders
 and maintaining massive and detailed databases of location
 etc, and the purpose of that work is to give free assistance to 
 competitors
 to show them where to take your markets away from you, this
 effort is 100% counterproductive.   Not only do the results hurt you, but
 the time it takes away from a small businessman often comes
 at the expense of operations, expansion, or even quality of service.

 Perhaps people who sit behind desks in Washington DC don't care about
 anything but press releases where they get to praise themselves
 and get lauded on TV, but for those of us who risk our life's savings and
 often years of our lives building a business by
 bootstrap have a LOT more at stake than a transitory and soon forgotten
 political posture by some appointed or hired public employee.

 So, as a small businessman, I cannot state how incredibly wrong ALL of 
 this
 is, and that IN NO WAY should the FCC be in the business of
 deliberating wasting the time, money, and resources of small business
 people solely for the purpose of harming their future.

 So, in closing, I state for the record, there is no good aspect the
 collection of detailed information.  It is not and has never been
 the business of Congress or the FCC to provide broadband.  That's being 
 done
 by thousands of hard working people who have risked
 everything they have to try to make it happen.  It seems worse than
 Machiavellian, then, for the FCC to demand that these people then
 waste thier time, money, and energy, in an effort where the only result

What Ironic about the State rep's comments was

If they got the availabilty information from providers,  why would it be 
invaluable, if the intent to use the data was to let providers know where 
areas are under served?
THEY ALREADY HAVE  THE DATA YOU COLLECTED IT FROM THEM!!! DUH!!!

There is a flip side though.

One of the most common occurances is, LECs and Cable Cos selectively picking 
when and where to serve someone or not, regardless of whether they could.
If the LECs and CableCos, were required to report who they said qualified 
it is a mechanism to hold them accountable for when they do not. Whether 
from the perspective of False advertising, or not honoring their 
monopoly/franchise obligations to serve.

The missing point is, SMALL PROVIDERS DONT HAVE THE INFORMATION.  The 
prupose should be to gather the information from incumbents, and given to 
competitor providers so that they can go after these less advantageous areas 
that nobody else wants.

What should be provided is that everytime a cable co or LECs gets a lead 
they can't serve, they should be required to report that they have declined 
to serve, and anytime a subscriber gets a response that they can't get 
served, there needs to be a place to record this information and make it 
known they desire to be served.

This should be the mechanism to inform competition. And use the information 
to establish Grant programs for small Providers.

The big mistake the government is making is they are trying to track where 
there IS broadband.  What they should be trying to track is where there is 
NOT broadband.

They should be tracking, anywhere (ZIP CODE), that there is recorded to be 
an underserved person, the area should be considered underserved.

I agree with all your comments but this one:

It needs to go beyond the zipcode(I understand the FCC wants this now, and will 
be heck for all of us)!

In my area, I am seeing the local incumbent rural telco serve two or three 
people to satisfy a ZIPCODE is offered broadband service. AlthoughI know 
the new reporting requirements the FCC wants can be a PITA to me, it might 
actually help in my situation.

[WISPA] Form 477 NPRM Comments Due

For those that may be filing comment on the Form 477 NPRM, please be
reminded that comments on the Section IV(B), which seeks comment on the
adoption of a national broadband mapping program and the Commission's
tentative conclusion that the Commission collect information that providers
use to respond to prospective customers to determine on an
address-by-address basis whether service is available, are due on July 17
(replies due on Aug. 1).   Comments on the other sections of the NPRM
(reporting number of lines and channels, delivered speed information
gathering, broadband price information, preserving confidentiality and
broadband customer surveys) are due on Aug. 1 (replies due Sept. 1).

 

This is Docket Number 07-38 and I have attached the NPRM pdf.  You can go to

to reach beyond city limits, FCC data providing greater specificity about 
which potential
customers are adversely impacted by the digital divide and left without a 
viable option
for service would be invaluable.

That ought to turn your stomach into knots.

Let me interpret it...

We want detailed data, so we can help,cajole, coerce, or bribe the big guys 
into universal coverage.

This is not a question of the FCC determining how broadband is being 
deployed.

This is a matter of us being required to provide the data so that public 
money can be used to benefit the politically connected.

My comments to the FCC...

As a small businessman, one of the ways that we exist, is by being flexible 
and by offering services in an ad-hoc basis that larger,
inflexible entities don't.   Often, small businesses are purely based upon 
market need.   Individuals find a need and fill it.  And we
do so in our own town, or neighborhood, or in the areas near where we live.

One of the most critical efforts that small business people undertake, is to 
determine if there's a large enough market for what they
want to do.   Often, little funding is available for this, and they 
substitute days, weeks, or even months of time and personal effort
instead of hiring research companies or marketing consultants, or buying the 
data outright.

In the case of a wireless ISP, for instance, one of the most critical 
elements for success, is to map out an area, and then begin
building out a network.  Many such WISP's are one or two man operations, 
and start with minimal capital, usually enough to get
started and operate in a limited area for a short period of time.   Then, 
funding from operations then provides capital for expansion
and improvement of infrastructure.

During this phase of the life of a WISP, the financial situation is 
generally very fragile, and a loss of markets to move into will
generally cause business failure.

If WISP's are required to do even MORE work, such as finding census borders 
and maintaining massive and detailed databases of location
etc, and the purpose of that work is to give free assistance to competitors 
to show them where to take your markets away from you, this
effort is 100% counterproductive.   Not only do the results hurt you, but 
the time it takes away from a small businessman often comes
at the expense of operations, expansion, or even quality of service.

Perhaps people who sit behind desks in Washington DC don't care about 
anything but press releases where they get to praise themselves
and get lauded on TV, but for those of us who risk our life's savings and 
often years of our lives building a business by
bootstrap have a LOT more at stake than a transitory and soon forgotten 
political posture by some appointed or hired public employee.

So, as a small businessman, I cannot state how incredibly wrong ALL of this 
is, and that IN NO WAY should the FCC be in the business of
 deliberating wasting the time, money, and resources of small business 
people solely for the purpose of harming their future.

So, in closing, I state for the record, there is no good aspect the 
collection of detailed information.  It is not and has never been
the business of Congress or the FCC to provide broadband.  That's being done 
by thousands of hard working people who have risked
everything they have to try to make it happen.  It seems worse than 
Machiavellian, then, for the FCC to demand that these people then
waste thier time, money, and energy, in an effort where the only result 
possible, is to harm them.

3)   If a revised Form 477 is submitted after the filing due date of
September 4, 2007, it should not show Original Filing as the answer to
Cover Page question #7.  Instead, that answer should be changed from

It's due tomorrow and all WISPs should be filing it. It'll only take 10
minutes to fill out but the info is vital for the FCC to know that the WISP
industry is alive and growing. WISPs can't expect the FCC to create useful
rules if they don't know how many WISPs there actually are.

Technically, then, it's not considered filed. You have to either mail
or fax the Certification Statement (i.e. page 14 of the instructions),
in addition to either emailing or snail-mailing a floppy or CD with the
spreadsheet.

Oh god here we go again with a ton of emails saying we are breaking the law.  I 
have never signed mine and the FCC has gladly accepted past filings.  I think 
the FCC would rather just have something filed and since they are all lawyers 
do seek more then some are willing to give but with a precedence of accepting 
just the report and not one filed letter stating otherwise lets not make this 
another technicality argument.  We are doing what 75% of our industry aren't - 
we file our report, end of argument until they get uptight and make a point of 
enforcing it.

I'm surprised no one has complained about their use of Microsoft Excel. 
Form 477 does not work with OpenOffice. They sent me a PDF to fill out 
instead.

Microsoft Office, while not necessarily the best software, is a /de 
facto/ standard, and keeping a copy around is, I'd argue, just a cost of 
doing business.

But that does lead to an interesting side question (to which I don't 
have the answer): Do they actually count the results of spreadsheets 
that don't include the signed certification statement? They do at least 
some correlation between the two - a year ago, I emailed the form, and 
UPS'ed the signature sheet. They received the signature but said they 
couldn't find the spreadsheet and asked me to re-send it.

I complained to the list at the first filing date, which got me a 
revised .xls which didn't work either...

Go figure.  The FCC now requires you to buy MS Office to fill out their 
forms...  (arrrggghhh).  Or not.  

Whatever the case, it complained that the form was protected and that opening 
it was not allowed.

That is a good idea, but why not be proactive and let the FCC know the 
concerns you have NOW (call, email or fax) and ask how you can help in the 
litigation. I'm still not clear what this group is trying to really 
accomplish. I'll assume that anyone that filed the 477 has a potential right 
to be a co-defendant in this matter. You may also consult with your attorney 
as well.

I hate to say it, but if the info contained in the Form 477 is not held in
confidence - like it is supposed to be, then I am going to sound like so
many others by saying that our Government can not be trusted. I will choose
to refrain from any further comments other than to say I hope that our
following the proper procedures and guidelines don't come back to bite all
us in the arse - - - as so many prophesied that chose NOT to fill out the
form 477.

Public Notice To Service Providers Who Filed FCC Form 477s With The
Commission And Sought

Confidential Treatment Of The Information Submitted

This Public Notice notifies all filers who sought confidential treatment of
their Form 477

information that the public release of this information is being sought. The
following litigation is pending

in U.S. District Court for the District of Columbia: Center for Public
Integrity v. Federal

Communications Commission, Civil Action No. 06-1644 (RMC). Plaintiff
initiated this action under the

Freedom of Information Act (FOIA), 5 U.S.C. § 552, as amended, seeking
release of all FCC Form 477s

filed with the Commission. The Wireline Competition Bureau previously denied
plaintiff's FOIA request

for these records, pursuant to FOIA exemption 4, because it found that the
requested records contain

commercially sensitive, competitive information and that release would cause
harm to the entities that

submitted the requested information. The plaintiff has filed for de novo
review of its request by the U.S.

District Court. The Commission's brief in this proceeding is due to be filed
with the court on January 8,

2007.

I remember once when a big corporation, to remain nameless, offered to buy me 
for a nice chunk of change then after we signed the NDA and they looked at my 
numbers they never called me or returned our calls again.  Mind you are the 
largest ISP in my town so it wasn't for lack of numbers.  They simply wanted to 
know how much business was in my town so they could justify whether they would 
come here and take us out.  The Form 477 is just another way for corporations 
to see how strong your market is so they can have you essentially research for 
them the feasibility for them to come spend three million (just a vague 
reference not a real number - you'll see if you read the rant) to run you out 
of business.

I'm done on the form 477 comment  but in a tell us how you really feel 
rambling (as Marlon would say) here is what I think of our competition:  
rantThe new corporate motto is, 'Why buy an existing customer base for a 
million when we can come to their market and spend three million in advertising 
or free/under cost services to force them out.'  It's not naievety by the 
government either they know that corporations are basically greedy and corrupt 
but they donate well to political figures so if they have to do anything they 
can to please their stockholders more power to them.   Letters to the FTC, or 
Justice department asking for investigations of these many unethical acts are 
all unanswered during a Republican Adminstration. We're all old enough to 
remember when Republicans were the friend of small business, doesn't seem that 
long ago.   Oh sure they have small business loans out there but now you have 
to hire their buddies as Consultants for 1/4 of the loan value in order to fill 
out the overly difficult forms.   Government is just as unethical so how are 
they going to set the example for American corporations.

Service or community responsibilty is a luxury from them not like us who use it 
as our foundations.   That is why those two traits are the only thing that keep 
small business alive for those few customers who want to pay less at the cost 
of being on hold for 1/2 hour for service they don't get anyway.   Look at 
Charter Cable, Paul Allen needed a write-off for his huge profits on Microsft, 
got it by writing off investors losses as his own so he didn't have to acutally 
spend that money!  Or Clearwire which is Craig McCaws write-off dupped Intel 
and Microsoft into bailing his failing venture out.   

Neither give a damn about their customers other then they pay their bill so the 
stockholders don't sue them for making their stock (in Charter's case) go from 
$30 to a buck or so.  I can't believe I'm admitting it but I think Bill Gates 
is much more of a 'True American' then either of those other scum I mentioned.  
 At least he uses his write-off for good.   Even if Windows is a crappy 
program, it did bring the world into the computer age so good for him which 
made them customers of ours, well until Allen or McCaw steals them to the tune 
of another billion dollar or more loss. /end rant

I'm glad this is being taken to court. One of the reasons many WISPs don't
file still (even though legally required to), is because they are afraid
that the information will be shared with someone that will result in a
negative effect, whether its the tax collector or competitors.  Proving that
this information can or can not be kept confidential will take a load off
the mind of parties that are obligated to file.  Hopefully, the FCC will be
victorious and not need to disclose the information.

The Center for Public Integrity is suing under FOIA (Freedom of 
Information Act) for access to the 477's because they do not believe 
that the broadband data that the FCC reports is true and they want to 
add that raw data to their media report at

already.  Just nothing specific to a company.  And specific company data 
won't do anyone any real good.

 I wonder how or if the privacy checkbox will effect the released data if
 they win.

 Also the information will be relatively worthless for what these people
 are supposedly looking for.  When the form is filled out, we only report
 total numbers and zip codes covered.  Granted if you serve only 1 zip
 code then it is obvious where your customers are.  Even in my small
 coverage area I serve 4 zip codes and only one of them has any
 substatial number of customers.

 What I will find disturbing is if they are successful in getting my
 customer count released.  So what if I find out that Qwest has umpteen
 billion DSL customers and they serve my zip code.  I already knew that.
 However if Qwest of any of the miriade of resellers can see that I have
 X customers in my area they may decide that marketing there is now a
 good idea because of the uptake potential.
