My understanding of chapter 8.2.7 in bis-05 is that a 1xx (non-100, that is) provisional response MUST contain a To tag. This was discussed on the SIP mailing list a long time ago. If I remember correctly the use of the To tag in provisional responses was then added to the bis as a SHOULD, but has then became mandatory.
