Correct, you can't take someone else's work and release it under a different license. You don't have the right to do that. Just like you can't take a CC licensed work that is marked as NonCommercial and relicense it under a Commercial license. Just like GPL'd code, and how people think it can 'infect' their software project. Lots of software and web site/services have a license/TOS that they can change at *any time* and you must abide by it. For instance, Movable Type used to have a license that said they could demand you to delete all copies of their software at their request. Sure, for many people this would me deleting their weblog, but for folks who had clients using Movable Type, this was a huge risk. In most cases bad things do not happen, and it's just a misunderstanding between people - developers, business folks, users and lawyers - each trying to look out for their own well being.
