Paul, More fundamentally, are you on the free iCloud plan, as that only comes with I believe around 5Gb of iCloud storage.
Noting that this is for everything you use for iCloud, contacts, e-mail etc, it could be that your iPhone backup is larger than the space available, and as such, there is not enough room… which the error message may just be misleading you over… check the size of data on your phone, photos etc. and compare.
