Hi Kay,

The 4S came out in October 2011, so about 2 months shy of 2 years. You
wwould have to give some more information about the phone, e.g. did you buy
the phone on contract yourself and, if so, when exactly? If you got the
phone from somebody else I guess it depends on whether they cancelled their
contract, upgraded or whatever.
The main consideration for AT&T is that the phone can't be under contract
any more. Normally a 4S even if it was bought on day 1 of its release would
still be under contract for another 6 or 8 weeks unless somebody upgraded
early and paid a penalty to get out of the contract.
If your AT&T Store is nearby you can always try or you could simply call
them. All the accounts I have heard about on Today in iOS were from people
who called AT&T, I don't think I heard about anybody taking it to a store.

Regards,
Sieghard

Can I take an iPhone 4 s in to an AT&T store and have them unlock it if it
isn't the one I am currently using and doesn't have a CIM card in it?

Sean,

It will make all the difference in the world. If I were considering a used
iPhone 3GS, 4 or even 4S, I would never in a thousand years want to buy a
phone which was not already carrier unlocked. The resale value will be
accordingly higher since anybody who knows anything about this would feel
the same way. Maybe if somebody gave me a 3GS or 4 for free I'd take a
locked phone and then attempt to get it unlocked myself, but I wouldn't even
pay $10 for it.

Regards,
Sieghard

Oh, I'd agree there will be some people who will most certainly be
interested. However, the over all point I was making is that I don't think
whether it is locked or unlocked will make that much of a difference
regarding the price point that you can ask for it. I've still got mine &
have had it for 2.5 years now & it works great. I will be upgrading it soon
though & plan on keeping it right here as a back up phone just encase mine
gets messed up or something. So, I'm basically agreeing with your points
here as well.
