Rossi said repeatedly that he will only be paid after he delivers the 1 MW reactor. He has not delivered it, so Defkalion does not have to pay him yet. I do not know what the dispute is but no one has said they "did not pay" according to the contract.

OK, maybe you are right about the precise phrase "did not pay", though I feel I have read that phrase in this regard somewhere. I can not find the reference at the moment. It could just be my bad memory. I can't trust my memory any more. Also, it may have been an inference by someone posting, not from Rossi himself.

The problem causing the contract cancellation was stated by Rossi in August to be "just financial", "... not personal, nor technological, nor scientific". His delivery was slated for October, so it would seem that he has not violated that provision. See the following:

The Licence and Technology Transfer Agreement (The LTTA) contains a mile stone payment arrangement.
