   I think the issue can be resolved with a question of whether you have,
somewhere in your possession, an original manufacturer's diskette for the
product in question.  Whether that is adequate for the manufacturer may be
questionable, BUT... it would likely be enough before a jury of your
peers.

     It would seem that the manufacturer may not be polite in allowing you
to keep your original installation.  In many production environments,
upgrades/new versions are kept available in case the new version turns out
to be inadequate, flawed, or just flea ridden...

    Law is based upon argument.  Expensive argument... often before a
bunch of folks who have little better to do, and sufficiently limited
capability TO have little better to do...
