Whoever owns the copyright can decide how and where the graphics are used or
not used. You cannot use any graphic that you do not have permission to
use. If you buy a CD of graphics that states you can use it but not sell it,
then you have their permission to use. If the other site took that same CD
and started to distribute the pictures, even at no charge, they are likely
violating the provisions in the licensing that came with the CD (ie. how
could a CD manufacturer make any money off of images that are freely
available). I know of one manufacturer that simply went around various sites
finding free images, and then stuck it on a CD.. but their licensing states
this as well.
As to the "internet ruling" there is none. If someone grabs our logo and
uses it on their site, they are violating our copyright, even if they never
make a cent off of it.
Since this person states that they got the images from a CD, try to find out
which CD the images are on and go that route. You can tell the owner of the
CD that she should read the copyright statement that comes with the CD. As I
said, I've got one CD that states that the graphics come from "free graphics"
sites. As you own the graphics you have created, you have the right to have
them removed from the other site regardless of whose CD those graphics happen
to be on.
