Interesting dilemma you find yourself in here. I won't presume to dispense
legal advice -- Scott has that base covered, I think <g> -- though I will
emphasize, as others have, that the infringer's claims about "Internet
rulings" and "royalty-free" images are utter crapola. Your retain the
copyright for your images, and people can't redistribute them without your
permission.
Anyway... I was intrigued by your comment that you could find no
information on the Web about "Simmerman Graphic CDs", and I saw that as
a challenge I couldn't pass up <g> Regrettably, I didn't do any better
than you at locating them, but I did unearth a few potentially relevant bits
of info.
First, "Mt Perry OH" appears to be a mighty miniscule bit of terrain all in all.
It is not officially referenced in the Ohio government's site, nor on the US
Census site; not on tax rolls, lists of municipalities or anywhere else that I
could find. It is mentioned in passing as the place of residence of a
couple of people arrested for drug possession, however :)
A search of the Web as a whole didn't turn up much other than, again,
addresses of people who list "Mt Perry OH" as their residence. However,
there is a "Perry County" in Ohio, and the zip code for the county office is
similar to the one listed above, "43760". So Mt Perry is presumably
somewhere in or around Perry County.
I next assumed that the "Simmerman" in "Simmerman Graphic CDs" was the
last name of the owner, and dug through various Web directories seeking
it vis-a-vis Perry/Ohio. Again, not much. I did determine that the area
code for the Mt Perry region is 740, and that there are a handful of
Simmermans who live within that area code. So presumably there could
have been a "Simmerman Graphic CDs" operating in Mt Perry at one time,
owned by someone named -- yep -- Simmerman.
I then put the string "Mt Perry OH 43760" through Metacrawler, and came
up with a veeerrry interesting match: a link (now unfortunately defunct)
to youonline.com. Here's how the hit displayed:
Advertising at an Honest Price
Target-Market Advertising: The place on the Internet where your ad will
be noticed! Are you tired of placing your ad on "free" boards as well
http://youonline.net/brenda/ (Lycos)
As noted, the http://youonline.net/brenda/ URL was defunct. However,
this does strongly suggest that Ms Ring did once have a page on her site
which referenced the address she provided for Simmerman Graphic CDs.
Yet a search on "Simmerman Graphic" at Metacrawler does not produce
any hits, at youonline.com or elsewhere. Interesting.
Anyway, enough detective work for one day. It was an interesting
challenge -- trying to track down hard data on the Web from some
fragmentary evidence -- though I don't really know what the whole
exercise proved. But it was fun :)
