Hi Paolo!

As I already mentioned in the last mail "The maps are based on the
LK8000 maps".
I will now comment on each one of you sentences, just so there is
nothing left that is unclear...

"I am the one who made the over 170 map sets, naming each zone, setting
coordinates, checking all of them."
Correct, thanks for the work!

"And then preparing the topology."
Correct, thanks for the work under the Creative Commons License!

"Ok, you are not obliged to ask for authorization to use openstreet
maps, and in fact you did not ask for it."
Correct, and I apologized for not asking already.

"But Templates ?? You copied all templates, copyrighted work of mine,
and people will access my database of templates on xcsoar map site."
First of all, there was no copyright notice in the templates. Second of
all, I have my doubts that map boundaries can be copyrighted.

"No asking, no reporting of authors, no permissions, nothing."
Check the info.txt file in each of our XCM files, you and your project
are included in the credits, just like the original source, the
OpenStreetMap project.

"It looks like you are simply using LKmaps topology."
The shapefiles are the same, but with a tweaked "topology.txt".

"False: you are using the whole LKmaps database, including templates,
text files, which are not free stuff and in any case - again - I have
never been asked for an authorization."
As I mentioned earlier, map boundaries are not something that can be
copyrighted. And besides your "templates" we use nothing but the
shapefiles which are under the Creative Commons License.

"Then I go on the xcsoar web site, no mention to lk, to me, to anyone."
I'm assuming that you meant the "Map Downloads" page... There is no need
for mentioning you or your project there because the website itself
doesn't include your work. The files that are offered for download
include your work and therefore you are mentioned in the "info.txt" file.

"Remove all my templates and copyrighted stuff at once!"
Nope. Sorry, but I don't see the point in you giving us a lecture about
copyrights after what you've pulled off in the last year... Think about it!

I am really surprised by your reaction on this whole matter. After all,
everything we do here is for our personal happiness and if others can
benefit from that, Great! I don't see the point in fighting each other...

After all, the whole story can be described like that:

- Some people created XCSoar
- XCSoar was made open source under the GPL
- You forked from XCSoar, creating LK8000 (also GPL after some time)
- You created valueable maps under the Creative Commons License
- We wanted to give our users the possibility to use your freely
available maps and activated the use of *.LKM files
- We noticed that your LKM files don't contain terrain and that the zoom
threshold levels are modified to fit your software
- We created GeoJP2 terrain based on your LKM files
- We modified the zoom levels
- We packed everything as XCM files
- We published them on our website giving you credit in the info.txt
file included in every single XCM file

I think that I've made our position on this whole matter clear enough.
If you have still any questions feel free to ask!

Greets,

Turbo
