Comrade,
Your question is vague to give an opinion but at least find hereuder the basics 1. You should establish when the decision was taken, was there any consultation with workers involved, what is the criteria of identifying the workers to be retrenched, are the affected workers presented with opportunities to provide alternative arrangements to avoid or minimise retrenchments, has the employer explored on its own instance other alternatives to retrenchments, is the retrenchment based on Operational requirements (ask for Business rationale document/Document of Intent) take this info and go and consult with your Union if you have, if you dont have go and consult with your lawyer. Do not sign any doc without consulting your union/lawyer. As for the payment; you are entitled to at least one week pay for every year of a continueos/unbroken service and all other monies that were due to you e.g leave and outstanding bonuses (if awarded). I must emphasize though that it is important to join a union if there is one in your environment because these matters would be dealt with through them. Hope that will help "ALL YOUNG AND OLD REVOLUTIONARIES TO THE FRONT" Stera Senti > Date: Thu, 1 Jul 2010 09:18:06 +0200 > Subject: Re: [YCLSA Discussion] Relationship between employer and the workers > From: [email protected] > To: [email protected] > > Morning Comrades, > > While still addressing Cde Tsinengs point, pardon me if i am throwing > you off the main topic but i could`nt help but think to take this > opportunity to ask: What does one do when they are headed to be > retrenched?
