Or can you just change the sort order on the table so that it sorts by Status? That way the Open records would be towards the top of the table?

The menu you're selecting from just fires workflow that changes the qualification for the table showing the related records. You could add another entry to the list and add active links that change the qualification so that it only displays Incidents where 'Status' < "Resolved". I would copy the existing active links and just modify them accordingly. You'll need to do some logging to determine which workflow is firing.
