There have been earlier instances too -- Like the coroners inquest in
South Australia where the coroner attempted to proffer the view that
winch launching should only be carried out with cables which don't have
any joins in them, and that if the cable breaks it should be completely
replaced before operations continue.
That's the thing you're not quite getting here, Geoff: The difference
between an ATSB report and a GFA report is that the ATSB report can be
presented in court as prima-facie evidence of what happened. The GFA
report can't. I know that you dearly want them to be equivalent, and that
you keep saying that if the ATSB can publish them there's no reason why
the GFA can't, but as long as you ignore that point you'll continue to
stimulate conflict.
Can anyone please clarify what Mark is saying ..... has the GFA had
legal action taken against it BECAUSE OF ANY ACCIDENT OR INCIDENT REPORT
THAT IT HAS PUBLISHED TO ITS MEMBERS?
That's not clarifying what I've said, that's answering a yes or no
question which you've contrived.
Will also take this up with one of our members who is a Barrister and
also an aircraft owner.
Interesting -- I'd have thought that since we've been talking about this
off and on for over a year on this list, you might have done that already.
