No, for now the program is not illegal. The Hamadan case is specifically looking at a time when it was most definitely illegal. However, it remains to be seen whether the current system is legal and whether there is any recourse for victims of the illegal acts in the past. But if you prefer, I'll say that you supported the warrantless, secret, unsupervised wiretapping program. The change in the tax rates are being done in an open legislative process. You can call it whatever you like, I don't care. But it is not secret and it is being debated over in both the public sphere and the legislative sphere, both of which you have recourse to. Unlike, say, the warrantless wire tap program. I don't support Obama having the power to raise your tax rates without any checks or balances, in secret, by executive order that is itself secret, selectively on individuals with severe penalties for anyone that knows about the tax program talking about the existence of the tax program.
