Responsibility can be argued 24/7 with as many opinions as their are people
talking about it.  Your example with the gun depends on the circumstances.
If you left the gun lying on a windowsill, loaded, without a trigger lock
then I would say that yes, you ARE responsible for someone else using it.
Is it your FAULT that someone else gets killed?  No, but you can be held
accountable (ala OJ Simpson).

However, if you have it stored out of sight, say on a high closet shelf or
in a safe, with ammunition in a different location with a proper trigger
lock and someone still managed to steal it and murder someone with it then I
would not hold you responsible for it because you took appropriate
precautions to prevent unauthorized use.

Applied to movie swapping, I hold Todd responsible for continued
distribution because he is purposefully making the media available, telling
others where it is, and otherwise encouraging others to download and view
it.  What would you think of someone who did the same with their firearm?
Would you want your kids playing at their house?
