No, citizens don't have to produce papers. There is nothing here to require that. You may be required to give your name, but that is nothing new, and is required in most US states. But you are not required to produce documents.
And, if the police DO try to require that, I expect hundreds and thousands of people, as a form of non-violent protest, to refuse. Although Judah brought up Terry stops, many legal opinioners don't believe Terry searches will apply here, since the court very specifically forbid such searches to COLLECT EVIDENCE. "The meaning of the rule is to protect persons from unreasonable searches and seizures aimed at *gathering evidence*, not searches and seizures for *other purposes* (like prevention of crime or personal protection of police officers)." So, stopping a person and frisking them, for the purpose of developing reasonable suspicion that they are illegal, is not a valid stop. You are correct. There is a very large population that are of Mexican and South American ancestry, and lots and lots with Spanish, who are citizens. Like maybe 30% of the population (about 2.2 million). Of which maybe 500K are illegal. That means that about 3 out of 4 Hispanics are NOT illegal. Which makes profiling based on race and accent and language NOT rise to the level of reasonable suspicion. The math just doesn't work. It cannot be justified. If they start doing it, and try, then ALL OF THESE PEOPLE YELLING, and all of this media, and all of these civil rights lawyers, will be all over them to call them on it. I think the spotlight is firmly on them at this time. Let's see how they do in the harsh glare of public scrutiny.
