Oh yeah? Have you ever bailed someone out of jail? Maybe it is the stipulation in that state that the guy would not drink or operate a vehicle, or maybe he signed papers saying he would take the guy home. But even if he had taken the guy home, and then guy then went back out and drank, would Powell still be responsible?

They usually keep you in jail til you sober up and he obviously had time to go drink some more before the wreck. It is just like a bar that lets a person drive that is too drunk to do so, they can be fined for allowing it.
