My feeling on this entire mess is

We have a separation of Church and State.

Somehow marriage has gone from being a religious institution to a state
institution (Federal and state benefits that only benefit married couples).
Therefore, marriage or unions between people which get civil benefits should
be taken out of the religious realm and put solely under state/federal
control. Somehow marriage is both a state and a religious contract at the
same time, which is where the fundamentalists come in.

Meaning that anyone (under the non discrimination laws) can sign a contract
to benefit from and have the responsibilities of the state and federal laws
with another person. (Civil Union)

If someone also wishes to create a union recognized by a certain religion,
that is fine and they have to conform to that particular religion's rules
and procedures for that type of union, but they derive no state/federal
benefit from that type of union (They can get both types or one).

Divorce on a civil level releases those from the state/federal benefits and
obligations. Those who are also in a union recognized by a religion must
also petition that religious authority for a separation (but that is
separate).
