The domain must not have been very important since it was non-functional for 40+ days before deletion and re-registration by someone else. So 4 1/2 months later (135 days) they realize their site isn't working. What can you do to protect yourself from being sued? Contact an attorney and accountant for advise. What can you do in this case? I would just wait and see if they really do file suit. Most are usually just blowing a lot of hot air... However don't take this as legal advise, I'm not an attorney and I don't even play one on TV.
