I think it's understandable that Tucows wants to be very cautious and
conservative before changing any domain record. Should Tucows simply
change the ownership of Microsoft.com, Citicorp.com or any other
valuable domain (especially domains owned by my company!) that are
registered at Tucows based on someone's simple assertion that the name
is "stolen?" There are 2 sides to every story. You should see some of
the crackpot emails my company receives, it's incredible. Often,
thieves themselves will attempt to use social engineering to claim a
name is stolen, in order to steal it. I appreciate that Tucows is a
professional organization that I can count on, unlike many of the
alternatives.
You might have a valid claim. But, due process is important.

P.S. I don't think Tucows is perfect -- security can always be
improved, and I'd still like to see some simple things be added (e.g.
an email to a user-specified list of addresses upon every login to the
RWI would be a trivial but very strong way to prevent and detect
unauthorized use; even some credit card companies are starting to do
this after every purchase). Ideally, this would be done by ALL
registrars, for improved security of the entire industry.
