If you're aware of that, then you're being
disingenuous to say it isn't in the
Constitution. It's just as misleading as
to say "freedom of religion" isn't in the
Constitution because that exact phrase isn't
in the Constitution.
I'm not being disingenuous at all because the intent of the founding fathers was to prevent any laws that established a state religion not to prevent the free exercise of religion by the people. If it were taken as you are trying to suggest all traces of religion would have been wiped away long ago, from the moment the constitution became the law of the land. But it wasn't.As I have said so many times so far Congress opens each cession with prayer which somehow is illegal in schools. Federal appointees are usually given an oath to take on a Bible  and one swears to uphold the law SO HELP ME GOD etc. None of this establishes a state religion but does allow the free exercise of.
